ODIE’S OIL GIVEAWAY TERMS AND CONDITIONS
1. THE GAME ORGANISER
1.1 The organizer of the game announced on odiesoil.eu Instagram page https://www.instagram.com/odiesoil.eu/ (“Game”) is Looks Wood Kft. (registered office: 6076 Ágasegyháza, Bajcsy-Zsilinszky út 36.; company registration number: 03 09 133774; tax number: 26338628203) (“Organizers”).
2. CONDITIONS OF PARTICIPATION
2.1 The Game is open only to European citizens over the age of 18 who are resident or domiciled in Europe and have an Instagram profile (“Profile”;)
2.1. play a “Game” on the Instagram page odiesoil.eu located on the website at https://www.instagram.com/odiesoil.eu/ (the “Website”), – during which you will complete at least once the tasks of the Game Periods
2.1.2 agree to all the terms and conditions set out in these game rules (“Game Rules”) and the guidelines provided by Instagram and consent to the use of your personal data provided to the Organizers
2.2. The submitted Entry may not be edited or otherwise modified afterwards, and one (1) Player is entitled to submit one (1) Entry per period of time during the duration of the Game.
2.3. Employees of Looks Wood Ltd. are excluded from the Game.
2.4. Participants will be identified by their participation in the Game based on the data provided. The Organisers shall not be held liable for any technical problems (in particular, but not limited to, changes in data, deletion of Instagram profile, etc.) resulting from any changes to the data that are beyond the Organiser’s control.
2.5. Applications that do not comply with the formal and content requirements described in the Rules of the Game will be automatically disqualified from the Game.
2.6. The Organiser will automatically exclude from the Game all Players who participate with false data.
2.7. The Organizers will only consider valid those Entries that are submitted to the Game via the Instagram profile registered by the Players. If the Player does not use an Instagram profile registered by him/herself, the Organiser excludes all liability for any disputes arising from the right to use the e-mail account or Instagram profile in connection with the Game.
2.8. By submitting an Entry, the Player acknowledges that the content, performance, message and data transmission and response speeds of the technical infrastructure of the Game are dependent on the server technology and may be adversely affected by factors beyond the control of the Organisor , such as (but not limited to) connection failure, server computer performance, network load, network congestion, coverage and the maintenance of a secure network connection. The Organizers disclaims any and all liability arising from this paragraph.
2.9. The Entries may be examined by the Organizers for compliance with the terms and conditions of the Rules, and if for any reason they or the Player submitting them do not comply with the terms and conditions of the Rules, the Player concerned may be disqualified from the Game.
2.10. Players who, contrary to the spirit of the Game, participate in the Game under the name of a natural person in a team, or with mass-generated email addresses, Instagram profiles or Instagram profiles containing non-existent persons, with the aim of increasing their chances of winning by such deceptive behaviour, may be disqualified from the Game at the discretion of the Organizers. Such players include, for example, persons who associate to participate in sweepstakes and other contests, coordinate their actions to win prizes and combine the performances of several persons under one name, thereby depriving other players who wish to play fairly of their chances of winning. Such persons shall also include those who participate in the Game with false information for the purpose of unfairly increasing their own chances of winning. Players who engage in unfair conduct as defined in this clause shall be liable to compensate the Organiser for any damage caused to the Organiser in connection with the Game.
3. DURATION OF THE GAME
The Game will run from 2023.08.17. 10:00 until 2023.08.21. 23:59 CET.
4. HOW THE GAME WORKS: WINNING APPLICATIONS
4.1. The Organiser will make the game post available on the odiesoil.eu Instagram page at 10:00 CET on 2023.08.17., which the Players can play with during the Game. To participate in the giveaway, participants must follow odiesoil.eu Instagram page, tag a person in a comment under the original post with whom they would like to share the prize.
4.2 Prize draw
4.2.1 The Organizers will hold one (1) draw in total during one (1) Game among the valid entries received by the date of the draw, and will draw 1 prize among the players who have participated on Instagram. The draw will take place within 48 hours of the receipt of the entries at the Organiser’s place of business (address: Wesselényi utca 16. 1077 Budapest). The draw will be conducted by means of a random machine draw.
4.2.2 The Organizator will also draw a total of 1 reserve entries in each draw. The Reserve Winner will be entitled to the prize in the order of their draw as set out in Clause 3, in the event that the Winner’s entry is invalid for any reason or the Winner is disqualified from the Competition for any other reason related to their entry.
4.3. Prize:
The Organizer will announce the prize of the given game in the same Instagram post as the announcement of the game.
4.4. 1 Player can win 1 time during the game. The Prize is non-transferable and cannot be redeemed for cash.
5. WINNER NOTIFICATION, PRIZE DELIVERY
5.1. The Organiser will notify the winner of the Prize no later than 5 (five) working days after the day of the draw by replying to the comment with the answer to the Game and/or announcing the winner in the text of the original post announcing the game and/or by sending a message on Instagram. All Players expressly consent to this method of notification by entering the Game. The Winning Player shall provide the personal details (name, telephone number, address, tax identification number) necessary for the delivery of the Prize within 5 (five) working days of the Notification. If the Winning Player does not respond to the Notification within the time limit set out in this clause, the Winning Player shall no longer be entitled to the Prize and the Organizers shall be entitled to select a reserve winner and deliver the Prize to the reserve winner.
5.2. The Prize will be sent by post to the address provided by the Winner on 1 (one) occasion. Postal charges will be borne by the Organiser. The Organiser is able to claim the Prize subject to these conditions. If the Winning Player fails to comply with this obligation to cooperate, and thus the claiming of the Prize under the conditions set out in this clause is not possible, the Organiser shall not be liable for the consequences of such failure. The Organiser cannot provide any other means of collecting the Prize.
5.3. The Organizer shall exclude from the Game any participator for whom the Prize cannot be awarded because the personal data provided by the Player are not true, incomplete or incorrect, or the Player who submitted the Contest does not meet the personal requirements described in these Rules, in particular, the Player is under the age of 18. The Organisers shall not be liable in any way whatsoever as a result of incorrect information provided by the Player.
6. TAXATION, COSTS
The Organiser is liable for any VAT due on the Prize. The Organiser shall have no further obligations other than the delivery of the Prizes as described above and the payment of their tax deduction.
7. DATA PROTECTION, PERSONAL RIGHTS
7.1 The provision of the information described in these Rules is voluntary. Those who participate in the Game acknowledge and expressly consent to.
7.1.1 The Organizers, as data controllers and data processors, shall process the personal data provided solely in connection with the Game, for the purposes of contact, administration and the delivery of the Prize during the duration of the Game and until the delivery of the Prize, as described in this Clause 7;
7.1.2 if they win, their name and Instagram profile picture will be disclosed by the Organisers without any further conditions or consideration, solely in connection with the Game;
7.1.3 by participating in all respects, expressly accept all provisions of the Game Rules.
7.2. The Organiser warrants that the data will be processed in compliance with all applicable legal provisions. The Organiser shall provide the Player with the opportunity to request information about the processing of his/her personal data, to request their deletion, blocking or rectification at any time by e-mail to info@odiesoil.eu. In addition, the Player has the right to object to the processing of his/her personal data.
7.3. The data controller: Looks Wood Kft.
The data is processed by Looks Wood Kft. (registered office: 6076 Ágasegyháza, Bajcsy-Zsilinszky út 36.) as the data processor.
7.4. If the Player requests the deletion of his/her personal data during the duration of the Game, he/she acknowledges that he/she will lose all rights to the Game and will be disqualified from the Game.
8. MISCELLANEOUS PROVISIONS
8.1 The Organisers shall not be liable for any omission/error in the Entries (e.g. misspelling, misspelling of names, incorrect or untrue information, etc.), for any failure to deliver the Prize or for any delay in delivery of the Prize, or for any damage caused during delivery, which is beyond the control of the Organisers.
8.2. If the Winning Player does not collect his/her Prize in accordance with Clause 5.2, he/she may no longer claim it.
8.3. The Organizers exclude any liability for any external attacks on the www.instagram.com website or the server hosting it, so-called SQL attacks. Therefore, in the event of an attack on the website or the server resulting in players receiving incorrect system messages regarding their prizes, winner/non-winner status, etc., the Organizers shall not be held liable in any way.
8.4. The Organiser reserves the right to exclude a player from the game with immediate effect if it detects or has reasonable grounds to suspect any (computer) manipulation, mass emailing, creation of Instagram profiles, or any other behaviour that is incompatible with or in any way offensive to the spirit of the game.
8.5. If the player closes the browser window while submitting the Contest or if the connection (for any reason) to the server’s website is lost, the Organisers will not be liable for any loss of data.
8.6. The Organisers exclude any liability for any failure of the Site due to causes beyond their control, during which time the Site may be unavailable or restricted but will take all necessary measures to promptly investigate and rectify the cause of the failure.
8.7. The Player agrees, in accordance with the Instagram Promotions Policy, to refrain from asserting any claim for damages or other liability against the instagram.com website operator (Meta Platforms, Inc. and its subsidiaries and affiliates) in connection with the Game. The Game is in no way sponsored by Instagram or affiliated with Instagram in any way. The data is not provided to Instagram but to the Organiser. (This promotion is in no way sponsored, endorsed or administered by or associated with Instagram.)
8.8. The Organiser reserves the right to modify the terms and conditions of the Game without giving any reason, including the termination of the Game.
